New York massage therapist sentenced for Capitol riot involvement: ‘I just want to go home’

A New York massage therapist who joined the mob of Trump supporters attacking the U.S. Capitol was sentenced on Tuesday to three months in jail, capping a case in which he skipped court hearings, profanely insulted a prosecutor and berated the judge who punished him. Frank Rocco Giustino pleaded guilty in February to a misdemeanor charge related to the Jan. 6, 2021, riot at the Capitol. But he was arrested last month after failing to appear in court for an earlier sentencing hearing. U.S. District Judge James Boasberg told Giustino that he seemed to have no remorse for his conduct on Jan. 6 or any respect for the court’s authority. JAN. 6 CAPITOL RIOT – ONE YEAR LATER, DC REMAINS ON EDGE THE CAPITOL RIOT AND REVISIONIST HISTORY: THE BATTLE OVER THE JAN. 6 LEGACY “Your behavior from the moment of the (guilty) plea until sentencing has been about the worst of any January 6th defendant I’ve had,” the judge said. Giustino said he condemns the violence at the Capitol and didn’t intend to be disrespectful. “I just want to go home,” said Giustino, who will remain in custody for approximately two more months. The judge sentenced Giustino to 90 days of imprisonment with credit for the roughly 30 days that he has remained in custody while awaiting sentencing. Prosecutors recommended a sentence of four months of incarceration. They initially asked for a 21-day sentence, but they sought a longer term of imprisonment after Giustino disrupted a June 23 court hearing with defiant outbursts. During the June hearing, Giustino derided his case as “an absolute clown show of a prosecution.” He told the judge that he fired his lawyer and wanted to represent himself. He also used language that appeared to comport with the sovereign citizen extremist movement’s belief that the U.S. government is illegitimate. “We’re not doing any sentencing date,” he said, according to a transcript. “Have you guys heard anything that I have said? Have you seen anything that I have filed? This is not a real court. There is not a single judicial officer here presiding on my case.” The judge told Giustino to act in a “civilized fashion” and said he would issue a warrant for his arrest if he didn’t show up in court for his sentencing. “Why don’t I issue a warrant for your arrest? I think the U.S. marshal should come after you, not me,” Giustino told the judge, punctuating his rant with expletives directed at a prosecutor. Assistant U.S. Attorney Douglas Collyer said Giustino sent him an email on Sept. 5 in which he referred to his prosecution as the “very definition of terrorism,” said he would appear in court only as a “courtesy” and demanded the dismissal of his case along with an apology. “The defendant’s behavior has been disrespectful and belittling, to put it mildly,” Collyer told the judge. Giustino pleaded guilty in February to parading, demonstrating or picketing in a Capitol building, a misdemeanor with a maximum sentence of six months of incarceration. More than 400 other Jan. 6 rioters have pleaded guilty to the same charge. Giustino failed to appear in court twice after he pleaded guilty, missing a status conference in June and a sentencing hearing in September. The judge issued a warrant for Giustino’s arrest after he skipped his sentencing. He was arrested in Florida in October. Giustino initially was arrested on Capitol riot charges in January 2022. Before the riot, Giustino frequently posted on Facebook about conspiracy theories that the 2020 presidential election was stolen from Trump, the Republican incumbent. He took a bus from his home on New York’s Long Island to Washington, D.C., to attend Trump’s rally near the White House on Jan. 6. He joined the crowd walking to the Capitol, where rioters disrupted the joint session of Congress for certifying Democrat Joe Biden’s electoral victory over Trump. HOW THE CAPITOL RIOT CAME TO FRUITION AND WHO MADE IT HAPPEN Giustino entered the Capitol through a door roughly three minutes after other rioters broke it open. “Before Giustino made the decision to approach the door, he posted on social media that police were using tear gas against him and the other rioters, condescendingly calling law enforcement ‘civil servants,’ an affront to the hundreds of officers injured that day protecting democracy,” prosecutors wrote in a court filing. Giustino was in the Capitol’s Crypt when rioters overwhelmed a line of police officers. He joined other rioters in a chant inside the Rotunda. He spent about 35 minutes in the Capitol before leaving. Approximately 1,200 people have been charged with federal crimes related to the Jan. 6 attack. Nearly 900 of them have pleaded guilty or been convicted by juries or judges after trials. Over 700 have been sentenced, with roughly two-thirds of them getting terms of imprisonment ranging from three days to 22 years.

Travis Kelce’s mom, Donna Kelce, apparently feels like she fumbled an answer about Taylor Swift. In his new interview with WSJ. Magazine, Travis spoke about his mother’s appearance on “Today” in October, when she spoke briefly about Swift. According to the outlet, Donna felt she came off less than excited about interacting with the “Cruel Summer” singer.  During the “Today” interview, Donna was asked if their time in the box at the Chiefs’ game was the first time they had met. Social media platform X hit United Nations Secretary-General Antonio Guterres with a community note that countered a claim he made about the deaths in the Gaza Strip as Israel continues its offensive against Hamas.  The official U.N. News account on X posted several quotes from Guterres’s press conference on Monday, when he insisted, “We are witnessing a killing of civilians that is unparalleled and unprecedented in any conflict since I have been Secretary-General.”  The post received a community note, which allows users to provide additional context for “posts that might be misleading,” pointing to at least two conflicts with significant death tolls either equal to or above the death toll in the Gaza Strip – the Syrian civil war and the Yemen War, which have seen hundreds of thousands killed.  An Israeli official told Fox News Digital, “The Secretary-General has lost any moral standing. He willfully ignores the thousands of civilians killed in conflicts in Ukraine, Syria, Yemen, and elsewhere, as he pursues vilification of Israel. Shame on him.” UNITED NATIONS SLAMMED FOR SILENCE OVER HAMAS RAPES, MUTILATION AND MURDER OF ISRAELI WOMEN, CRITICS SAY A spokesperson for the secretary-general told Fox News Digital that Guterres stood by his comments, initially noting that Guterres was responding to the “large number of civilian casualties reported so far in Gaza” and argued that the numbers cited in the community note “are still below the 11,000+ deaths counted so far in Gaza” and the Yemeni casualties “preceded the secretary-general’s term.”  The spokesperson then argued that Guterres “was clearly talking about the casualties among children,” noting the comment followed a list of the numbers of children casualties in various conflicts over recent years.  “Although he did use the word civilians in the last sentence, the focus of what he was saying, and the statistics he provided, were about child deaths,” the spokesperson claimed.  UN OFFICIAL CAUSES UPROAR OVER CLAIM THAT ISRAEL DOESN’T HAVE RIGHT TO DEFEND ITSELF AGAINST HAMAS TERRORISTS Guterres had also stressed in his comments that he was not going to enter into “discussing the accuracy of the numbers that were published by the de facto authorities in Gaza.” Guterres took office in 2017, and in that year, the Syrian civil war saw over 10,000 civilians dead. The Yemen War, which began before Guterres took office, has claimed over 377,000 deaths, with the U.N. reporting that one child died every seven minutes in the Yemen conflict in 2022 alone – though this includes deaths due to starvation or disease.  The Hamas-controlled Gaza Health Ministry has reported over 11,000 people have died in the Gaza Strip since Israel started its bombing campaign in response to the Oct. 7 terrorist attack that killed 1,200 people.  CANADA, 5 EUROPEAN COUNTRIES LOOK TO JOIN GENOCIDE CASE AGAINST BURMA The ministry’s number does not distinguish between combatant and civilian deaths, nor does it specify how they die – much like the U.N. figures for Yemen. The U.N. maintains that the ministry’s numbers have held up to scrutiny in past conflicts and have largely proven accurate.  Israel’s Permanent Representative to the United Nations Gilad Erdan blasted Guterres for his comment, writing on X, “Short memory? I think not. More likely that it’s the regular bias and anti-Israel approach of the secretary-general.” Erdan has called for Guterres to resign after losing “all morality and impartiality,” saying that Guterres “distorts and twists reality.” Guterres pushed back on the claim, insisting that he has “condemned, unequivocally” the Oct. 7 attack and does not in any way endorse terrorist acts.  “I clearly state, and I quote, that the grievances of the Palestinian people cannot justify the attacks by Hamas,” he said in his defense.  The secretary-general’s spokesperson did not respond to queries about the claims of an anti-Israel bias at the U.N.

U.S. Special Presidential Envoy for Climate John Kerry announced Monday he will unveil a first of its kind global strategy to commercialize nuclear fusion energy at an upcoming United Nations summit in Dubai.  “Fusion energy is no longer just a science experiment,” Kerry said during a visit to the Commonwealth Fusion Systems (CFS) corporate headquarters in Devens, Massachusetts, near Boston, previewing the plan. “Benefitting from decades of investment from the Department of Energy’s world-leading Fusion Energy Sciences programs, it is now also an emerging climate solution.” “I will have much more to say on the United States’ vision for international partnerships for an inclusive fusion energy future at COP28, during an event on December 5,” Kerry added, according to a readout of his remarks. CFS, a spin-out of the Massachusetts Institute of Technology (MIT), is working to bring fusion power plants to market. The 28th UN Climate Change Conference (COP28) will be held from Nov. 30 to Dec. 12 at Expo City Dubai in the United Arab Emirates.  ‘TYRANT’ JOHN KERRY SLAMMED FOR SCOLDING CLIMATE CHANGE DENIERS: THEY’VE ‘THREATENED’ ‘HUMANITY’ Two sources tipped off Reuters before Kerry’s announcement Monday. They told the outlet the former Secretary of State’s plan foresees strengthened cooperation with other countries and serves as the first international strategy aiming to speed commercialization of nuclear fusion.  As a U.S. senator more than a decade ago, Kerry supported legislation that funded research at MIT seeking to replicate fusion, or the process that powers the sun and stars, to generate electricity on Earth. The process aims to use lasers or magnets to smash two light atoms into a denser one, releasing large amounts of energy.  If done successfully, fusion could have an important advantage over nuclear fission plants that split atoms, as it does not produce long-lasting radioactive waste, and could also provide a cheap source of carbon-free electricity, according to Reuters.  WHITE HOUSE SILENT AFTER JOHN KERRY LAMENTS UKRAINE WAR’S CARBON EMISSIONS Due to economic uncertainty and inflation, investments in the clean energy industry have stalled this year.  The Fusion Industry Association (FIA) tracked international fusion companies as having garnered about $1.4 billion in investments for a total of about $6.21 billion in mostly private funding in 2023. That is a decline from the $2.83 billion in new investment recorded in 2022.  While some skeptics fear fusion will be too expensive and take too long to develop to adequately address climate change, this year’s COP28 is viewed as an opportunity to court support from global partners to plan international deployment of the technology.  From 2022 to 2023, FIA said the number of companies receiving investments in global fusion jumped from 33 to 43. Commonwealth Fusion Systems is one of about 25 of those companies in the United States, while other nations investing in fusion technology include Australia, China, Germany, Japan and the U.K. Kerry toured the Boston-area company with CFS CEO Bob Mumgaard and Claudio Descalzi, CEO of Italian energy company Eni.

CHIP AND JOANNA GAINES ON WHY THEY LEFT HGTV: ‘THINGS STARTED GETTING COMPLICATED’ “Jo and I are in this beautiful moment. We’re evolving into each other,” Chip added. “It’s the second part of our marriage.” While the power couple celebrates two decades of marriage, Chip, 49, and Joanna, 45, admit they “see life differently now.” Chip and Joanna have had their hands tied for years as they gear up for new projects, including launching a podcast network, upcoming Magnolia reality shows, building Hotel 1928 in Waco, and debuting their new limited series, “Fixer Upper: The Hotel.” The pair first found fame flipping houses as the “Fixer Uppers” on HGTV, but momentarily pivoted away from the cameras in 2018. A gunman opened fire at a Walmart in Ohio on Monday night and wounded four people before killing himself, police said. The shooter walked into the store on Pentagon Boulevard in Beavercreek at around 8:35 p.m. and began firing at people inside. He shot and injured four people who were rushed to area hospitals, Beavercreek Police Captain Scott Molnar said. Their conditions were unknown. The shooter then turned the gun on himself, police said. His name, a motive for the attack and other details were not immediately released. RELATIVES OF MAN FATALLY SHOT BY POLICE AT WAL-MART IN OHIO SEEK STORE VIDEO FROM SHOOTING Beavercreek is a town of around 50,000 people and is about 50 miles north of Cincinnati. Police said on social media last night that the store had been cleared and secured and there was not any active threat. No shots were fired by any responding officers, police said. The FBI, the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Ohio Bureau of Criminal Investigation and other local agencies responded to the scene, police said.  WALMART EMPLOYEE IN CHESAPEAKE, VIRGINIA, KILLS 6 WITH PISTOL, POLICE SAY “Our thoughts and prayers are with the victims and families impacted by this horrific tragedy,” the Beavercreek Police Dept. wrote on X. “We will release more information as it becomes available.” Walmart echoed those words in a statement. “We’re heartbroken by what’s happened at our Beavercreek, Ohio store,” the statement reads. “This remains a developing situation, and we’re working closely with investigators on the scene.” This is the second major shooting incident at the Beavercreek Walmart store in just under a decade. Police fatally shot John Crawford III, of Fairfield in Butler County, inside the store in 2014 when police mistook the pellet gun he was carrying for a real gun, according to Fox 19.  Angela Williams, who had been shopping at the store at the time of the 2014 shooting, died of a cardiac event as she attempted to flee the store. Sofia Vergara opened up about the personal and professional challenges that she has faced over the past year.  The 51-year-old actress referenced her highly publicized divorce from her husband Joe Maganiello and the SAG-AFTRA strike while reflecting on her experiences in 2023. “I’ve had a very interesting year,” Vergara told People magazine. “I don’t want to say ‘bad’ or anything like that, but it’s been very interesting and very difficult.” “I went through a divorce this year, the SAG strike that went on for so long,” the “Modern Family” alum continued.  In July, the Screen Actors Guild – American Federation of Television and Radio Artists (SAG-AFTRA) joined the Writer’s Guild of America in their strike against the studios, streaming services and production companies represented by the Alliance of Motion Picture and Television Producers (AMPTP), which marked the first time that both unions had been on strike simultaneously in six decades. SOFIA VERGARA ASKS COURT TO UPHOLD PRENUP WITH JOE MANGANIELLO IN NEW DIVORCE FILING Actors were asking for increased minimum pay rates, increased streaming residuals and guarantees from studio and production companies about the use of artificial intelligence. The SAG-AFTRA strike, which halted film and TV productions and left thousands of people unemployed for months, ended after 118 days in early November. “I’ve seen my friends struggle — some had to take their kids out of their schools or had problems with their mortgages, so it’s been a weird, weird year,” Vergara told People. Despite the difficulties of the past year, Vergara told People that she was optimistic about the future. “It’s not like it’s bad,” the actress added. “I think all the things are resolving, everything is going to be okay and I’m very excited for next year.” Shortly after the SAG-AFTRA strike began, Vergara and Manganiello, 46, announced that they were divorcing after 7 years of marriage.  “We have made the difficult decision to divorce,” the two wrote in a joint statement to Page Six at the time. “As two people that love and care for one another very much, we politely ask for respect of our privacy at this time as we navigate this new phase of our lives.” The former couple met in 2014 at the White House Correspondents’ Dinner, which Vergara attended with her then-fiance Nick Loeb. Manganiello and Vergara began dating after her engagement to Loeb ended and they went on to tie the knot in November 2015.  The “Magic Mike” star filed for divorce from the Colombia native on July 19, two days after the split was announced. Vegara responded to her estranged husband’s divorce filing requesting the court uphold the couple’s premarital agreement in documents filed on July 26 and obtained by Fox News Digital. Per the documents, Vergara and Mangniello’s date of separation was listed as July 2. Both Vergara and Manganiello cited “irreconcilable differences” as the reason for the divorce. After the former couple’s split was announced, a source told People magazine that Vergara and Manganiello “always put on a good front publicly,” but weathered through “ups and downs for a long time.” “They’d be fighting or bickering, but then plaster on smiles when others were looking,” the insider said. “Their physical attraction to each other only carried their marriage that far,” another source told the outlet. The source continued, “On a day-to-day basis, there are so many other things that need to work. There were several things that didn’t work.” Prior to announcing their divorce, the duo had sparked speculation of marital troubles when Vergara celebrated her 51st birthday on July 10 during a girls’ trip to Capri, Italy without Manganiello. Fans also pointed out that the actor’s birthday tribute to his wife was notably less affectionate than in previous years. In late August, Vergara returned to the judges’ table alongside Simon Cowell, Heidi Klum and Howie Mandel on “America’s Got Talent.” During the live show on Aug. 22, Mandel poked fun at Vergara’s newly single status. Jewish students responded to antisemitism on their college campuses, including chants for an “intifada revolution” and “Holocaust 2.0” and “F–k Israel” graffiti on the walkways, which sparked an investigation from the University of Maryland.  “There is only one solution. Intifada revolution,” pro-Palestinian students chanted on Nov. 10. The university responded to the demonstration by denouncing antisemitism. However, students Shayna Leibowitz, Emma Steinhause and Benjamin Blain are concerned about whether the university was just giving them lip service. Blain’s family member – a 16-year-old girl – was killed during one of the Palestinian intifada terrorist attacks in the 2000s and said hearing the chants was “quite traumatic.”  “The university has been understanding, but there hasn’t been action taken… And if action isn’t taken, these actions will proliferate and it will lead one to another. And we don’t want to have to deal with those consequences,” Blain said. ANTISEMITISM ON TODAY’S COLLEGE CAMPUSES ECHOES THE DARK PASTS OF MANY ELITE AMERICAN UNIVERSITIES “In regard to the intifada. [UMD has] one of the largest Jewish communities, with 2,000 Jewish kids on this campus. And a lot of kids here have direct family members that were either murdered in the intifada or have grandparents that survived the Holocaust,” he said.  “My relation is my mother’s first cousin, one of her cousins was murdered, a 16-year-old girl sitting in a pizza store during the intifada,” he said. “And [Jewish students] having to deal with sitting in their biology classes, hearing outside hundreds of students referencing the Final Solution, calling for an intifada on UMD campus. It’s just a really unfortunate reality.” Steinhause described feeling scared to be on campus.  “It made me feel pretty scared because that is a call to violence and that has no place on our campus. I’m happy for people to represent whatever views they do have, but I think having any sort of call to violence on our campus is unacceptable. And the lack of like any sort of address from the university about that has really shocked me,” Steinhause said.  The intifadas were periods spanning years of intensified Palestinian terrorism. The first (87′-93′) is sometimes referred to as “The Intifada of Stones,” where Molotov cocktails, grenades and rocks were used against Israelis.  During the Second Intifada, Palestinian suicide bombers used increasingly powerful bombs to kill larger numbers of Israelis in their terror attacks. Terrorists would include shrapnel in the bombs and would dip the fragments in rat poison, an anticoagulant, so the victim would have a higher chance of bleeding to death, Israeli officials said.  “As a Jew, I am still proud to be Jewish and proud to be who I am. My identity. And I don’t want to hide who I am. However, I do fear being Jewish on campus sometimes because it does put a larger target on our backs or everything that’s been going on,” Leibowitz said.  About the “Holocaust 2.0” graffiti, she said, “I kind of just was more in shock that someone would write something like that. I just don’t understand how someone could write that in a public setting and think it’s okay.”  “We are aware of the hateful, antisemitic sentiments expressed at today’s demonstration organized by Students for Justice in Palestine. We condemn it in no uncertain terms,” the university said in a statement. “The offensive actions of a few should not reflect on the vast majority of protesters who were there to peacefully express their views, but there is no place for any antisemitic message, behavior or action at the University of Maryland.” CLICK HERE TO GET THE FOX NEWS APP The university also said it launched an investigation and The University of Maryland Police Department (UMPD) has launched an immediate investigation and continues to conduct real-time threat assessments, saying, “Responsible parties will be held accountable.” Fox News Digital reached out, asking for the status of their investigation, but did receive a response on that question.  “The health and safety of every member of our campus community remain our highest priorities. There is an increased police presence on our campus with more high-visibility patrols as part of the University of Maryland Police Department’s (UMPD) robust and comprehensive safety plan. Happy 81st birthday, Mr. President. (I always know when Biden’s birthday is because it’s the same as one of my kids.) He didn’t have a big celebration yesterday, unless you consider pardoning turkeys a whole lot of fun – for obvious reasons. Yet plenty of news outlets used the peg for their is-Biden-too-old pieces., and NBC didn’t deliver much of a birthday present with a poll showing Biden at his lowest approval rating of 40%. Politico reported that when donors asked how to deal with the issue, his deputy campaign manager said to focus on Biden’s historic accomplishments, a response that “was well-received by those who see his age as a mark of his deep experience – and met with disagreement by others, who fear not enough is being done to remind voters that former President Donald Trump is just three-and-a-half years younger.” BIDEN CRACKS AGE JOKE ON 81ST BIRTHDAY, THEN CONFUSES TAYLOR SWIFT, BEYONCE Even close allies “believe that Biden is mentally up for the job, but some acknowledge that the president can at times appear frail.” You think? Some want more joking about Grandpa Joe – Biden said yesterday “it’s difficult turning 60.” “I think everyone knows it’s an issue, and we have to address it,” former chief of staff Ron Klain is quoted as saying. The White House should emphasize that “it gives him more wisdom and experience, how he’s navigated this difficult problem in Ukraine.” A CAPITAL PROTEST COUNTERS ANTISEMITISM AS ISRAELI TROOPS ENTER GAZA HOSPITAL Speaking of war, 70% of Democrats in that NBC survey disapprove of Biden’s handling of Israel’s bloody conflict with Hamas. This reflects a deepening divide within the Democratic Party, especially among its youngest voters. In fact, the president’s approval rating among those 18 to 34 has dropped to 31%.  Among Democratic voters overall, 51% say Israel has gone too far, while 27% believe Israel’s military actions are justified. By any objective measure, Biden has done well balancing rock-solid support, including his trip to Israel after it was brutally attacked by Hamas, with urging restraint as the Gaza death toll soars, but if you view Israel as a terrorist oppressor, your view of the president’s role is going to be negative as well. And the sour icing on the cake, so to speak: Trump edges Biden by 2 points in a 2024 matchup. There’s even a companion Politico piece on how Democrats are coping with all this bad news (in part by rationalizing that he was underestimated in 2020). Now look at this contrast in yesterday’s Washington Post, which, along with the New York Times, has repeatedly been warning of the dangers of a second Trump term. TRUMP VS. BIDEN: A DRAMATIC DIFFERENCE IN HOW THE MEDIA TREAT EACH CAMPAIGN “No president has ever attracted more public detractors who were formerly in his inner circle. They are closely watching his rise — cruising in the GOP nomination contest and, in most polls, tying or even leading President Biden in a general election matchup — with alarm. Among them are his former vice president, top military advisers, lawyers, some members of his Cabinet, economic advisers, press officials and campaign aides, some of whom are working for other candidates.” Most of the facts here are previously known – the story is true – but the retelling builds a case that not all the criticism is coming from political opponents. Some, including former Trump lawyers Jenna Ellis and Sidney Powell, are trashing their former boss in exchange for guilty pleas and no jail time in the Georgia election fraud case. Perhaps the most interesting commentary comes from Trump’s second chief of staff, retired general John Kelly: “I came out and told people the awful things he said about wounded soldiers, and it didn’t have half a day’s bounce. You had his attorney general Bill Barr come out, and not a half a day’s bounce. If anything, his numbers go up. It might even move the needle in the wrong direction. I think we’re in a dangerous zone in our country.” The response from the former president’s spokesman Steven Cheung is purely Trumpian: “These media whores are always looking for their next grift — whether it’s book deals or cable news contracts — because they know their entire worth as human beings revolve(sic) around talking about President Trump.” One thing is certain: No matter the twists and turns of the campaign, including Trump’s criminal trials, there is one issue that by definition cannot go away, and that is Biden’s age. At least, from his standpoint, he won’t have another birthday before the next election.

To protect children, we need to fill these gaps in AI policy




Today’s hot trend for policymakers is talking about artificial intelligence. This incredibly powerful technology is here to stay, and new research shows that most of us are optimistic about how generative AI will be able to improve our lives.  But there are some new and concerning threats to which policymakers must pay attention. This includes a horrific misuse of this positive tech: bad actors abusing AI to put real people in sexually explicit situations, including minors.  This criminal use of AI tools is not just reprehensible; it could destroy a person’s life and dignity. There is currently a gap in the law addressing such conduct that may allow bad actors to go free, and policymakers need to address it now to ensure the culprits can be appropriately held to account.  Hundreds of laws already make illegal many of the ways bad actors can abuse AI tools. If AI is used to commit fraud, we have laws against fraud. The same is true for using AI for illegal discrimination, and the list goes on.  WHAT IS ARTIFICIAL INTELLIGENCE (AI)? Every existing law applies to AI like it does to its offline corollaries. But gaps do exist, and Americans are getting hurt.  One such gap remains when it comes to prosecuting predators handling sexually explicit images of minors. Today’s laws require such images to be real, live-shot photos. But abusers are using AI tools to escape justice by claiming in court that since the sexually explicit image of a real minor is “created by AI,” it’s not “real,” and thus not criminal. Unfortunately, the existing letter of the law is letting abusers escape the purposes of the law. At the same time, other bad actors leverage AI to generate “deepfakes” of innocent parties in compromising, sexually explicit positions. Think of this as a modern day photoshopping of a person’s head on another’s body – except now, the fake is more difficult to distinguish.  Once again, the laws on this are murky at best. Harassment and defamation of character are existing ways to prosecute an offender, but since this is “AI” and not a real photo, a legal gap exists that must be filled.  GOP LAWMAKERS SOUND ALARM OVER AI USED TO SEXUALLY EXPLOIT CHILDREN These holes in our laws could provide a dangerous haven for criminals, allowing them to hide behind the letter of the law while eviscerating its spirit. Thus, legislative attention is warranted and urgently needed. Lawmakers should act, not to ban or overregulate AI with a Red Tape Wishlist, but to patch these holes in our existing laws to ensure criminals can’t work around them to abuse innocent people. The first step for policymakers is to enact the Stop Deepfake CSAM Act. This simple bill updates existing child protection laws to make clear that it’s illegal if a criminal uses AI to “modify” sexual images of children. If they are using a real child in it, even if the rest is AI generated, this is child pornography. It is illegal, and policymakers must ensure these predators go to prison. Next is to approve the Stop Non-Consensual Distribution of Intimate Deepfake Media Act. This updates existing state privacy laws to make it clear that it is illegal to distribute AI images of an identifiable person with the intent to cause harm – addressing serious concerns about the horrific harassment of “deepfakes.” CLICK HERE FOR MORE FOX NEWS OPINION These changes empower law enforcement to punish bad actors using AI for nefarious purposes. This isn’t to say that just making something illegal will stop it, but this is a positive step to getting recompense for harmed parties. The pursuit of justice in the digital age must be dynamic and recognize the new dimensions AI introduces into criminal activity. This isn’t merely a legislative update; it’s a moral imperative.  The government must hold those who weaponize tools, including AI, against us accountable, which ensures that the digital world is an extension of our commitment to dignity, safety and justice. AI presents us with a great opportunity to improve our lives in so many ways. Our leaders must make sure that optimism and opportunity are allowed to thrive. Lawmakers must act now to protect the innocent and affirm that in our digital experience, America carries forward the principles that define us as a civilized society.  AI must remain a force for good, not a tool to be illegally abused by the reprehensible. President Lincoln supposedly sent his sincerest condolences to a grieving mother in the historic Bixby Letter on this day in history, Nov. 21, 1864. In the fall of 1864, Gov. John A. Andrew of Massachusetts sent a request to then-President Lincoln asking him to send his regards to Mrs. Lydia Bixby. Bixby of Boston was believed to have lost her five sons during the Civil War, according to Abraham Lincoln Online. ON THIS DAY IN HISTORY, NOVEMBER 20, 1925, ROBERT F. KENNEDY IS BORN IN MASSACHUSETTS  Lincoln accepted the request. As the story goes, he penned a letter to the grieving mother. Dear Madam, I have been shown in the files of the War Department a statement of the Adjutant General of Massachusetts that you are the mother of five sons who have died gloriously on the field of battle. I feel how weak and fruitless must be any word of mine which should attempt to beguile you from the grief of a loss so overwhelming. But I cannot refrain from tendering to you the consolation that may be found in the thanks of the Republic they died to save. I pray that our Heavenly Father may assuage the anguish of your bereavement and leave you only the cherished memory of the loved and lost, and the solemn pride that must be yours to have laid so costly a sacrifice upon the altar of freedom. Yours, very sincerely and respectfully, A. Lincoln The letter was printed and distributed by the Boston Evening Transcript. It was soon cherished as “one of the best letters written in the history of the English language,” according to a Time report. Among the praises it received: American poet and biographer Carl Sandburg called it “a piece of the American Bible” that “more darkly than the Gettysburg speech … wove its awful implication that human freedom so often was paid for with agony.” But the letter is not without controversy.  ON THIS DAY IN HISTORY, NOVEMBER 17, 1871, NATIONAL RIFLE ASSOCIATION FOUNDED BY CIVIL WAR VETERAN UNION OFFICERS The original copy was allegedly destroyed by either the newspaper’s editor or by Mrs. Bixby herself, who — as a sympathizer of the Confederacy — may have disliked Lincoln. Bixby’s great-grandchildren recalled this as Bixby’s political stance, according to the New England Historical Society. “I was advised by my father that my great-grandmother was an ardent southern sympathizer,” Bixby’s great-grandson said, according to the society.  “And when she received the letter, she destroyed it in anger … shortly after receipt without realizing its value.” It was later revealed that Bixby lost not five but two of her sons, Charles and Oliver, in battle, according to the New England Historical Society. On the 10th anniversary of the September 11 terrorist attacks, former President George W. Bush read the Bixby Letter during a memorial service at Ground Zero. In 2017, a team of forensic linguistics researchers used a tracing method that revealed 90% of the letter was identified as Hay’s writing, according to Time. Happy Monday. Control yourself – put your pants back on! So let’s talk about January 6th. I know, I know. But was it really, as our mainstream media contends, 9/11 and Pearl Harbor rolled into one? Well, thanks to the new House speaker, Mike Johnson, video from inside the Capitol building was just released almost three years later, showing what many who attended the protests have been contending all along – that not only were the Capitol doors more open than Hunter’s nose on a Saturday night – but in many cases, the Capitol Police either escorted the protesters in like ushers at a wedding or stood by without objecting. Now, let’s be clear. No one’s defending the chaos on the Capitol, so spare me the “Gutfeld” supports insurrection tweets from substitute teachers in Brooklyn still traumatized by Trump b**** slapping Hillary into retirement. I may not support riots, but I do support the truth and we have the right to hear the whole story, especially when many of the protesters were veterans and average citizens who just wanted their voices heard and who’ve been prosecuted like they were Hamas.  Actually, worse than if they were Hamas, because no one’s defending the Jan 6ers on campus. Just look at who was selected for the so-called select committee. You couldn’t get a worse roster if you combined CNN’s lineup with the cast of Saved by the Bell. Usually to get that kind of kangaroo court, you’d have to hop on a flight on Qantas. That’s an Australian airline. Yeah, there you go. What’s now clear is that any video that didn’t fit the committee’s narrative was ditched like one of Joe Biden’s grandkids. So who exactly was on this so-called bipartisan select committee? Well, on the Democrat side, well, it doesn’t matter. The faces change, but the lockstep slash goose step remains the same. One of them is House Dem Jamie Raskin, who’s already complaining about the released footage. JAMIE RASKIN: Beyond the partisan nature of it, it’s truly a security risk, what they’re doing. The reason why the Capitol Police have opposed releasing tens of thousands of hours from every House office building, every Senate office building, every part of the Capitol, is because it’s like giving a diagram to future insurrectionists and terrorists and anybody who wants to invade our body.  I think he’s full of s***. I wonder if he knows you could take a tour and see most of the Capitol if you want to. And most committee hearings are open to the public but the chances of the Dems giving conservative protesters and veterans a fair shake are roughly equivalent to Jesse Watters giving his hairstylist the day off. And any committee formed to uncover truth that includes Adam Schiff, it’s like making Ted Bundy the head of Visiting Angels. That would be a bad choice. The committee claimed to be bipartisan because it included Republicans Liz Cheney and Adam Kinzinger. And I’ll admit, it was good to have women represented from the Republican side. But didn’t we need two?  JAN 6 CAPITOL RIOT ‘QANON SHAMAN’ FILES FOR 2024 CONGRESSIONAL BID A SEXIST WOULD SAY! Yeah, Kinzinger cried more times during those hearings than a Kardashian at an onion eating contest. The puddles below Adam’s desk were so large the hearings should have had a lifeguard on duty. But Kinzinger got what he wanted of course, a job kissing up to Dems over at CNN where they’re used to seeing grown men cry, especially when the ratings come in. Hey Adam, maybe shoot a bit higher next time. I hear Media Matters needs a janitor. Then there’s Liz Cheney, who reportedly still has political aspirations. She just needs to bump her likability numbers up a bit. Right now, she ranks just above Jerry Sandusky and just below ISIS. So, Liz, Adam, let’s review some of the great work from you and the Biden DOJ. Here’s new video of Matthew Perna, a man who had no criminal record whatsoever walking calmly into the Capitol that day. Now, I don’t know what happened outside before, but clearly the police are not concerned or even directing the protesters to leave. Perna was initially charged with trespass, a charge he reportedly accepted. But when the Department of Justice decided to add a terrorism enhancement, it was more than he could take.  Matthew Perna took his own life. Here’s another new video of police releasing a protester. You don’t see too many terrorists that fist bump, do you? Except for Hamas. They do that after they kill innocent children and they’re still the toast of the Ivy League. So Matthew Perna gets a terrorism enhancement, which adds years to a sentence while the Antifa thugs who destroyed a police station in Seattle, attacked a federal courthouse and shut down cities while pretending to care about the Palestinians – they aren’t even investigated. You can even attack Democratic national headquarters as long as you’re anti-Trump. Meanwhile, literally hundreds of January 6th protesters are looking at decades in jail. And it’s Trump that this select committee referred for prosecution for mean tweeting. Now, one of the first ways you know you’re on to something is when the legacy media starts to sing in unison, like the Beach Boys on autotune.  Here are just a few headlines since the full videos came out. Notice the repetition, conspiracy theories, disinformation, and never Republican, it’s always far right. That’s how you know we’re over the target. It’s the hysteria. Because to the left these days we’re the terrorists and Hamas is the political party. Now, let me say it again so even the halfwits on The View get it. I don’t support attacking the Capitol building. I’ve seen those same three January 6th videos the committee and the mainstream media wanted us to see over and over a thousand times, and it’s cut together so well it was up for an Oscar in the category of best editing. But I’ve also seen a few other things from the same sources, like the Crossfire Hurricane conspiracy– thanks to two other CNN contributors, Peter Strzok and Andrew McCabe.  You won’t find two bigger dildos at an adult toy store. By the way, you can say dildo, it’s a medical term. And of course, there was the dismissal of the laptop from hell as Russian propaganda. And there’s the four criminal cases against Trump that wouldn’t have been brought against any other living soul or even a dead one like Nancy Pelosi. And yes, these new January 6th videos that contradict everything the select committee told us. Sadly, it’s too late for Matthew Perna, but maybe it’s not too late to recognize that some other people from the Capitol that day need to be investigated. And I’m not talking about protesters. Let’s just say a certain select group. And if the Republicans have a big day next November, it could be all over but the crying.

New York Giants rookie cornerback Deonte Banks decided to go on his Instagram Live to call out the Washington Commanders for not drafting him after Big Blue beat their NFC East rival Sunday for the season sweep.  Giants legend Carl Banks took the time to call out the young rookie on social media as well.  Carl Banks, a two-time Super Bowl champion with the Giants, doesn’t mind some smack talk here and there. He was the team’s third-leading receiver on the day.  “I’m just tryna figure out, though, did 17 play today?” Banks questioned using McLaurin’s jersey number.  Banks is a DMV native and went to Maryland, where he was a standout for the Terrapins. But the Commanders went for Forbes instead, and he’s struggled since coming out of Mississippi State. He’s been benched on multiple occasions by Washington, and his 19.1 yards allowed per reception is the third-highest in the NFL.  Banks, on the other hand, has done much better, allowing a 78.1 quarterback rate against while defending nine passes over 11 games thus far.
